Government contractors are faced with an ever changing landscape of new rules and regulations pertaining to insider threat assessment and cybersecurity.  This presentation will provide an update on latest developments and recommendations for best practices. 

 In May, 2016, DoD issued Conforming Change 2 to the National Industrial Security Operating Manual (NISPOM).  NISPOM Change 2 requires all US Government contractors who need access to classified information to implement an insider threat program that will compile and report information related to actual and/or potential insider threats among cleared employees.  Contractors are required to have an Insider Threat Program in place by November 30, 2016.  We will discuss the requirements of the program and offer best practices for compliance. 

 In the related area of cybersecurity,  contractors continue to face compliance challenges with the new FAR final rule on Safeguarding Contractor Information Systems.  We will discuss the new rule in tandem with FAR 52.204-21 and DFARS 252.204-7012 and the related requirements.  We will offer a summary and best practices for implementation of the 15 required basic security controls.

Jonathan DeMella, Partner, Davis Wright Tremaine LLP. Jonathan DeMella focuses his practice on government contracts counseling and litigation, including performance disputes, bid protests before the GAO and FAA, size and status protests before the SBA, civil fraud under the False Claims Act, procurement ethics, mandatory disclosure, and compliance with SBA laws and regulations, including those specific to Alaska Native corporations. He also conducts complex internal investigations, corporate compliance reviews, and in-house training programs for clients across the United States. 

 Lisa Marchese, Partner, Davis Wright Tremaine LLP.  Lisa Marchese has a nationwide practice in the area of government contracts counseling and litigation. Lisa provides full service expertise to clients doing business or seeking to do business with the federal government, including government contract formation, administration, and counseling on a wide range of performance disputes and compliance matters. Lisa has advised clients on protecting and preserving intellectual property rights when entering into and performing contracts with the federal government. She has also advised and assisted clients in compliance matters related to industrial security. Lisa regularly litigates government contract claims before federal and state courts, boards of contract appeals, arbitration panels, and other tribunals throughout the United States. Lisa also has a wealth of experience representing Alaska Native corporations and defense subcontractors within the government contracting process.
